These Terms and Conditions ("Terms") apply to all painting services delivered by Knoxville Paint Pros ("Company," "we," "us," or "our") to you ("Customer," "client," or "you") in Knoxville, Tennessee, and nearby communities including Farragut, Maryville, Oak Ridge, Sevierville, and Lenoir City.
When you request a quote, book a service, or hire Knoxville Paint Pros for a residential or commercial painting project, you accept these Terms. Please review them carefully before moving forward with any service agreement.
If you do not agree with any part of these Terms, please do not use our services. We may revise or update these Terms at any time, and the latest version will always be posted on our website at paintingcontractorsknoxvilletn.com.
Our Privacy Policy explains how we collect, use, and safeguard your personal information, and it is part of these Terms by reference.
1. Services Offered
Knoxville Paint Pros provides professional painting services for residential and commercial properties throughout the Knoxville, TN metro area. Our services include, but are not limited to:
- Interior painting (walls, ceilings, trim, doors, cabinets)
- Exterior painting (siding, brick, stucco, wood, trim)
- Deck and fence staining
- Drywall repair and preparation
- Pressure washing and surface preparation
- Color consultation
- Commercial and office painting
- New construction painting
- Cabinet refinishing and painting
All work is completed by trained, insured professionals who are employed by or subcontracted through Knoxville Paint Pros.
2. Estimates and Pricing
Free Estimates
We provide free, no-obligation estimates for painting projects within our service area. Estimates are prepared using the information gathered during the initial consultation and a visual review of the property.
Pricing Factors
The final price may change based on:
- Surface condition and the amount of prep work needed
- Paint type, brand, and finish selected
- Number of coats required
- Accessibility and height considerations
- Scope changes requested after the original estimate
- Unexpected conditions discovered during the project
Estimate Validity
Written estimates remain valid for 30 days from the issue date. After that period, pricing may change because of material cost shifts or seasonal demand.
3. Service Agreements and Contracts
Once a written estimate is accepted, a formal service agreement will be prepared. The service agreement will include:
- Detailed scope of work
- Total project cost and payment schedule
- Estimated start and completion dates
- Paint colors, brands, and specifications
- Warranty terms and conditions
Both parties must sign the service agreement before work begins. Verbal agreements are not binding unless they are confirmed in writing.
4. Payment Terms
Deposit
A deposit equal to 50% of the total project cost is due when the service agreement is signed to reserve your place on our schedule. This deposit is non-refundable if the customer cancels within 48 hours of the scheduled start date.
Final Payment
The remaining balance is due after the project is completed satisfactorily and the final walkthrough is finished. Accepted payment methods include:
- Cash
- Check
- Credit card (Visa, MasterCard, American Express, Discover)
- Bank transfer or ACH payment
Late Payments
Payments not received within 15 days of the due date may be charged a late fee of 1.5% per month on the unpaid balance. We may pause work or withhold warranty coverage until all amounts are paid in full.
5. Scheduling and Project Timeline
Scheduling
Project start dates depend on crew availability, weather, and the current project queue. We will include an estimated start date in the service agreement, but exact dates cannot be guaranteed because of factors outside our control.
Weather Delays
Exterior painting in Knoxville, TN is subject to weather conditions. Work may be delayed for reasons such as:
- Rain or high humidity
- Temperatures below 40°F or above 95°F
- High winds or severe weather warnings
Weather-related delays are not a breach of contract, and neither party will be penalized.
Project Duration
We will provide an estimated completion schedule, but the actual timeline may shift depending on project complexity, weather, and unforeseen conditions. We will keep you informed if the schedule changes.
6. Customer Responsibilities
To help the project run smoothly, customers agree to:
- Provide reasonable access to the property during agreed working hours
- Remove or relocate personal belongings, furniture, and valuables from work areas
- Keep pets and children away from active work zones
- Provide access to water and electricity as needed
- Share any special requirements, allergies, or sensitivities related to paint products
- Be present for the final walkthrough inspection
- Disclose any known lead paint, asbestos, or hazardous materials on the property
If these responsibilities are not met, the project may be delayed or additional charges may apply.
7. Paint Selection and Materials
Paint Quality
Knoxville Paint Pros uses premium paints from trusted manufacturers, including Sherwin-Williams, Benjamin Moore, and PPG. The specific brands and product lines will be listed in the service agreement.
Color Selection
Final paint colors must be approved in writing before work starts. We recommend testing samples on the actual surface because color appearance can shift based on lighting, texture, and nearby finishes.
Color Accuracy
We make every reasonable effort to match the chosen colors, but small variations can occur because of:
- Differences between digital screens and actual paint
- Surface texture and porosity
- Lighting conditions
- Drying and curing processes
Knoxville Paint Pros is not responsible for minor color differences that fall within industry-standard tolerances.
Material Ownership
All paint and materials purchased by Knoxville Paint Pros for your project remain our property until final payment is received in full.
8. Surface Preparation and Repairs
Standard Preparation
Our standard surface preparation includes:
- Cleaning surfaces of dirt, dust, and debris
- Scraping loose or peeling paint
- Sanding rough surfaces
- Caulking gaps and cracks
- Priming as needed
Additional Repairs
Drywall repair, wood rot replacement, and other structural repairs beyond standard prep will be identified during the estimate process and billed separately. If we discover unexpected damage during the project, we will notify the customer promptly and provide a revised estimate before continuing.
Lead Paint Disclaimer
Homes built before 1978 may contain lead-based paint. Knoxville Paint Pros follows EPA Renovation, Repair, and Painting (RRP) guidelines. Customers are responsible for disclosing any known lead paint presence. Additional costs may apply for lead-safe work practices.
9. Warranty and Guarantees
Workmanship Warranty
Knoxville Paint Pros offers a 2-year limited warranty on workmanship for residential painting projects. This warranty covers:
- Peeling, blistering, or flaking caused by improper application
- Visible brush marks, roller marks, or uneven coverage
- Paint failure due to inadequate surface preparation
Warranty Exclusions
Our warranty does not cover:
- Normal wear and tear
- Damage caused by the customer, pets, or third parties
- Damage from moisture intrusion, leaks, or structural defects
- Fading due to UV exposure (especially on south- and west-facing surfaces)
- Cracks caused by settling, shifting, or foundation movement
- Paint applied over previously defective surfaces not identified by the customer
- Areas subject to excessive moisture (e.g., shower surrounds, below-grade walls)
- Power washing or chemical cleaning of painted surfaces by others
Warranty Claims
To submit a warranty claim, contact us in writing with photos and a description of the issue. We will inspect the affected area within 14 business days. If the claim is valid, we will repair or repaint the affected area at no cost to the customer.
Warranty Transferability
This warranty may transfer to a new homeowner during the warranty period, provided written notice is sent to Knoxville Paint Pros within 30 days of the property sale.
10. Cancellation and Rescheduling
Customer Cancellation
- More than 48 hours before scheduled start: Full deposit refund minus a $150 administrative fee
- Within 48 hours of scheduled start: Deposit is non-refundable
- After work has commenced: Customer is responsible for payment for all completed work plus the cost of materials purchased
Rescheduling
Customers may reschedule once without penalty if notice is given at least 72 hours before the scheduled start date. Additional rescheduling requests may depend on availability and could lead to price adjustments.
Company Cancellation
Knoxville Paint Pros may cancel a project due to safety concerns, hazardous conditions, or failure to comply with these Terms. In that case, a prorated refund will be issued for any work not completed.
11. Liability and Insurance
Insurance Coverage
Knoxville Paint Pros carries:
- General liability insurance covering property damage and bodily injury
- Workers' compensation insurance for all employees
Certificates of insurance are available upon request.
Property Damage
We take care to protect your property throughout the project. If our crew causes damage during the job, we will repair or replace the affected item at our expense. Customers must report any damage within 48 hours of project completion.
Limitation of Liability
Our total liability for any claim related to our services will not exceed the amount paid by the customer for the specific project involved. We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, loss of use, or inconvenience.
Pre-Existing Conditions
Knoxville Paint Pros is not responsible for damage caused by pre-existing conditions, including but not limited to:
- Structural defects
- Water damage or mold
- Faulty construction
- Deteriorated surfaces
- Pest damage
12. Subcontractors
Knoxville Paint Pros may choose to use qualified subcontractors for part of the work. All subcontractors are screened, insured, and held to the same quality standards as our direct employees. Knoxville Paint Pros remains fully responsible for the quality and completion of all work performed under your service agreement.
13. Intellectual Property
All website content, including text, images, logos, project photos, and branding, belongs to Knoxville Paint Pros and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any content without our express written permission.
Project Photography
Knoxville Paint Pros may photograph completed projects for marketing use, including our website, social media, and advertising materials. We will not share identifiable personal information or interior shots of private spaces without your explicit consent. You may opt out by notifying us in writing before the project begins.
14. Dispute Resolution
Informal Resolution
We aim to handle concerns quickly and professionally. If a dispute comes up, please contact us first so we can try to resolve it informally.
Mediation
If informal resolution does not work, both parties agree to attempt mediation with a mutually agreed-upon mediator in Knoxville, Tennessee, before pursuing legal action.
Binding Arbitration
If mediation is unsuccessful, disputes will be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), held in Knoxville, Tennessee.
- The arbitrator's decision is final and binding.
- Each party bears its own costs unless the arbitrator determines otherwise.
- Class actions and jury trials are waived.
Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.
15. Indemnification
You agree to indemnify, defend, and hold harmless Knoxville Paint Pros, its owners, employees, and subcontractors from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:
- Your breach of these Terms
- Misrepresentation of property conditions
- Failure to disclose hazardous materials
- Unauthorized modifications to completed work
- Your negligent or wrongful acts
16. Force Majeure
Knoxville Paint Pros will not be liable for delays or failure to perform caused by events outside our reasonable control, including but not limited to:
- Natural disasters, severe weather, or flooding
- Pandemics or public health emergencies
- Labor strikes or supply chain disruptions
- Government orders or regulatory changes
- Power outages or utility failures
- Acts of war, terrorism, or civil unrest
When this happens, we will make reasonable efforts to finish your project as soon as practical.
17. Severability
If any part of these Terms is found to be invalid, illegal, or unenforceable, the rest of the Terms will remain in full force and effect.
18. Entire Agreement
These Terms, together with the signed service agreement and Privacy Policy, make up the entire agreement between you and Knoxville Paint Pros for the services provided. Any changes must be made in writing and signed by both parties.
